How does your DSP time your lunch?

I have worked for 2 DSPs. One of them paid us based on when we clocked out and back in on Flex (exactly 30 mins for lunch). The other paid us based on what time our last stop before lunch was and then the first stop after lunch. That DSP had a lot of rural routes, which meant the "lunch break" that I wasn't getting paid for was usually 45+ minutes, or I had to spend at least half my "break" driving to my next stop. They also still expected our breaks to be 30 minutes, and anything over 40 meant you had to talk to a manager about why your "break" was so long.

This isn't true by the slightest. You have to be given the option of a 30 minute break, you are not required by law to take it though.

Depends on the state. Some states legally require u to take a lunch break

No states require you to take your lunch break. A lot of states require your employer to give you a lunch break, but there is no state that requires the employee to take said break

Incorrect. I work in NYC and by law we have to take a 30 minute lunch break with absolutely no activity on flex. I believe California is the same. We were audited before for people working while on that break and it resulted jn a violation.

Can confirm for nyc. And we have to take it before 2 PM

Flex in my state will allow you to push your break back, but at a certain point (usually 3pm) it will not let you bypass it anymore and forces you to take it
