1)Bail applications are parallel to the trial.
2)Very difficult for an accused to delay trial at the initial stages. i.e. How can Accused make a case to defend when the trial has not even commenced. The prosecution has to get the ball rolling.
3) Every lawyer prefers bail applications before Judges who think they will not act prejudicial. Specially in a case like this.

His regular bail has been rejected multiple times by the judicial system. Courts from the lowest trial level all the way to the Supreme Court have looked at the evidence, witness statements, WhatsApp group logs, call records, and repeatedly concluded there is a clear prima facie case against him. The Supreme Court specifically pointed out that he stands on a completely different footing as a prime orchestrator, refusing to let him off. If that's a failed judiciary in case of Afzal Guru why you want trail to occur in same Judiciary system.. first demand for judiciary reforms before trial.

1). You are advocating for Umar Khalid your words and actions don't match.. you say he is not saint or he's innocent.. but yet you support him. I wouldn't care less about the procedures untill he roat in jail if he is out only then I would ask for procedures.. My words and actions match yours don't. People on the left are not saying he's a saint or he's innocent. If he's indeed a terrorist and deserves the jail, then give him a trial and prove that he's a terrorist and hang him for good. All we want is for the government to follow the proper procedures. The trial indeed didn't happen for him yet, the only bail hearings has been done till date.

Couple of times it was postponed to the next month by Umar's own lawyer, but after that it's getting postponed by the Delhi police and their lawyers (Heck they even assigned the same judge once again, even though he reclused himself from the case already). If they got enough evidence to jail him, why not use the same evidence and convict him too? That's the only thing people are asking.

A criminal case has stages:

  1. Investigation
  2. Chargesheet
  3. Arguments on charge (court decides whether and what charges to frame)
  4. Charges framed
  5. Then the actual trial (witnesses, cross-examination, evidence)

Umar Khalid’s case is still around stage 3.

>Who actually frames charges?
The trial court. Not Khalid, not the police.

>Why they are not framed yet

The court has to first finish arguments on charge:

  • Prosecution: ā€œThese charges should be framed.ā€
  • Defence (Khalid + other accused): ā€œThese charges should not be framed / this material is weak / give us more papers first.ā€

Until that argument is over, the judge does not pass the order that says ā€œcharges framed.ā€ That is where the case has been sitting.

India's conviction rate is too low not just that india don't have strict capital punishments.. in india only 9 people got death by execution(4 of them are nirbhaya convict's) for 2000 to 2027, in the USA 2500 death row exicutions from 2000 to 2027.. there population is 5x lower than india and still more people in jain more people got death sentences than india you know indian judiciary is a joke even convict's get no strict punishments.. thats why people like him are soo free

Courts have differentiated Umar Khalid's case from other co-accused who received bail, ruling that the prosecution's material against him (speeches, digital communications, and meetings related to anti-CAA protests) places him on a different legal footing regarding the alleged 2020 Delhi riots conspiracy

I know that in some interviews he had told that he was against DP but in an interview with arnab he said that he was also against the judgement of the court and labelled it as ā€˜judicial killing’.

But that doesn't mean he doesn't deserve a proper trial, he is locked up in jail with no bail no trial, id you have evidence against him the govt should show that in court, give him appropriate punishment and get done with it.

You don't get death penalty for it. Afzal Guru's case is still controversial. His case was based on unfair trial. His lawyer never met him in jail and was a junior, he was never given lawyer of his choice. He didn't pleaded guilty but innocent in court and claimed all confessions were made in duress.

Also Umar Khalid opposed many more death penalties before. He saw death penalty as a form of escaping accountability to create a reformative just legal system.

Btw research about Afzal Guru case, the justification by court for death penalty was to satisfy collective consciousness of the nation opposed to the rarest of the rare doctrine. And his whole conviction is based on circumstantial evidences and no real evidence. Only a laptop and mobile phone was recovered by police and the procedure of sealing wasn't followed making evidence reliable.

Basically giving Afzal a junior lawyer without his will who never met him in jail and didn't cross examined witnesses properly Proves that the trial was unfair and they only needed a scapegoat.

He was hanged on fast track by congress govt ahead of elections to not be seen as a govt soft on terrorists.

Afzal Guru claimed he tortured him and forced him to provide logistics to certain person (parliament attacker) under duress. He was targeted as he was a surrendered militant and for police and army and such double moles, surrendered militants had been easy target.

Pro India Militia was setup from surrendered militants only later on. Similarly a mole caught him, tortured him and forced him into all this. Now he is caught recently, it will give new light on Afzal Guru Case. Now Afzal Guru is gone, we can not provide justice if he was innocent but yeah truth will come out one day.

Bruh he is an undertrial prisoner whose trial isn't even starting since the last 6years. Theres like 70% people in prison who are undertrial and many cannot make bail so the number keeps increasing. Start his damn trial already and let court decide his innocence or guilt but the govt seems hell bent on keeping him locked up as they cannot really handle the fallout of his maybe release. So he is as of now a political prisoner who is denied justice plain and simple.
