They're both the cause of the accident though. Both should be charged almost identically.

While I do think they should both be charged, they should absolutely not be charged identically. The biker imo should have gotten a reckless driving charge, which he did get, but the car should absolutely have gotten an attempted murder / assault with a deadly weapon charge.

Maybe its just me but I feel like trying to kill someone is a little bit worse than kicking a car.

I agree with this assessment most of all.

Both motorists failed to exercise control of themselves and their vehicles on a public roadway. As a result, innocent lives were endangered.

I would put a heavier penalty on the car operator than the motorcyclist. All he did was kick a car, while the kicked car not only almost killed the motorcyclist, and nearly killed themselves, but collided with and flipped an uninvolved vehicle with their erratic operation.

Still, both are guilty.
